A parole officer shot two men at a nightclub in the Bronx early morning on September 2, 2024. The shooting happened after one man shot a lounge employee. The employee was shot in the leg. The shooting happened around 4 a.m. at a nightclub on East Tremont Avenue. The parole officer was working security at the club when he saw the shooting. He drew his gun and fired at the shooter, striking him twice.
Despite the fact that the security did return fire and subdue the shooter, the owner of the Nightclub may still be liable for the employees injuries. The owner of a Nightclub is like the captain of a ship. It’s the owner’s job to make sure everyone on board the ship is safe. If a storm is coming, they need to warn everyone and take precautions. If someone falls overboard, they need to do their best to rescue them.
Now, in the case of a nightclub, the “storm” is the potential for violence or danger. The owner has a responsibility to have reasonable security to ensure the safety of their customers and employees. In this case, the owner hired the parole officer who fired his gun and striked the shooter twice. One of the main questions will be whether this was adequate security. As well as was the security properly checking IDs and bags, as well as did the nightclub have adequate lighting and surveillance.
If the owner of any establishment doesn’t take these precautions, and someone gets hurt because of it, that’s called “negligence.” It’s like the captain failing to warn about the storm and someone getting swept overboard.
If proven that the nightclub was negligent, then the owner can be held responsible for the employee’s injuries. This means the nightclub may have to pay the employee compensation for:
- Medical expenses: All hospital bills, doctor visits, medications, and any future treatment they may need.
- Lost wages: If they had to miss work because of their injuries, they may have to pay them for that lost income.
- Pain and suffering: This is compensation for the physical and emotional pain they experienced.
- Loss of enjoyment of life: If these injuries prevent them from doing things they used to enjoy, they may be compensated for that as well.
The compensation is meant to help the employee whole again, as much as money can. It is critical as a business owner to ensure that you are providing reasonable security to keep your customers and employees as safe as possible. An injury or worst a death due to negligence has a life changing impact on multiple people beyond just the victims.
